TERMS AND CONDITIONS

  1. PURPOSE

The website www.cameleon-association.org (hereinafter the “Website“) is the website of the association CAMELEON (hereinafter “CAMELEON“), which presents its various charitable actions.

 Accessing, consulting, browsing and/or using the Website and its services implies full and complete acceptance of these general terms and conditions (hereinafter “T&Cs”), the purpose of which is to define the terms of use of the Website and its services by any person accessing, consulting, browsing and/or using all or part of the Website (hereinafter “User“).

Consequently, before any use of the Website, the User is invited to read these T&Cs. If the User refuses all or part of any of the stipulations of these T&Cs, he/she is requested not to use the Website.

The present T&Cs are accessible at any time on the Website and will prevail, if necessary, over any other version or any other contradictory document.

In case of online order on the Website, the User is invited to refer to the General Terms and Conditions of Sale.

  1. INTELLECTUAL PROPERTY RIGHTS

The Website and all of its elements, including but not limited to trademarks, logos, photographs, programs, source codes, object codes, data, databases, animated or non-animated images, sounds, drawings, graphics, videos, texts, layout, appearance, structure, as well as any other element not related to links to third party sites are the property of CAMELEON or are the subject of a license granted to it by any holder of intellectual property rights.

All these elements are subject to the provisions of the French and international regulations applicable to intellectual property and, consequently, are protected against any unauthorized use by the law or the present T&Cs under penalty – in case of failure – of legal proceedings.

CAMELEON grants the User a personal, non-exclusive and free right to consult and use the Website for his/her own use and within the strict framework of the operations authorized under the terms of these T&Cs.

Subject to these rights of use granted to the User by CAMELEON, the use of the Website does not entail any license or transfer of rights relating to the elements of the Website to the User. In particular, any copy, reproduction, representation, adaptation, modification or distribution of all or part of the content of the Website, by any means whatsoever and on any medium whatsoever, is unlawful without the prior express written consent of CAMELEON or the holder of the intellectual property rights.

Failure to comply with these stipulations, in particular for commercial purposes, may result in legal action for infringement and/or unfair competition and/or parasitism on the part of the holders of the rights in question. This is without prejudice to the other rights of CAMELEON, in particular the right to obtain compensation for the damage suffered.

  1. ACCESS TO THE WEBSITE

Access to the Website is technically possible twenty-four (24) hours out of twenty-four (24) and seven (7) days out of seven (7), subject to the occurrence of a case of force majeure, possible breakdowns or any maintenance operation necessary for the proper functioning of the Website and its services.

In any case, the User acknowledges that he/she has the necessary skills and means to access and use the Website. In this respect, the User must have a computer or any other device with an Internet connection, the settings of which allow the proper functioning of the Website.

In general, the User declares that he/she is aware of and accepts the risks involved in browsing websites and using online services. In particular, the User acknowledges that information passing through or stored on these sites may be intercepted or altered beyond the control of CAMELEON.

In this respect, it is strongly recommended that the User take all necessary precautions to protect him/herself against the effects of possible computer piracy, in particular by adopting a secure and appropriate computer configuration of his/her computer, cell phone or any other device used (e.g. by installing a regularly updated virus detection software).

  1. SERVICES offered on the website

4.1. Conditions of access to the services of the Website

To benefit from the services offered on the Website, the User must:

  • be of legal age;
  • have the required capacity to benefit from the services;
  • to use the Website and its services in accordance with these T&Cs and the General Terms of Sale when applicable. 

4.2. Services

From the Website, the User can :

  • make a donation to CAMELON ;
  • send a request to participate in CAMELEON’s sponsorship program in order to be contacted again;
  • place online orders on the Website (for more information, the User is invited to consult the General Terms and Conditions of Sale);
  • send a request for partnership with a view to being contacted again;
  • find out about volunteer opportunities and submit an application;
  • find out about job offers and submit an application.

Access to these different services implies filling in the mandatory fields of the form associated with the desired service. The User guarantees the truthfulness and accuracy of the information provided in this context. To learn more about the use of personal data by CAMELEON and how to exercise their rights in this regard, the User is invited to consult the Personal Data Protection Policy.

  1. GENERAL OBLIGATIONS OF THE USER

The User agrees to use the Website in accordance with these Terms and Conditions, the General Terms and Conditions of Sale when applicable and in particular not to use it for commercial purposes, canvassing, solicitation or advertising.

The User is also forbidden:

  • any behaviour that may undermine the integrity, operation or security of the system on which the Website is based;
  • any intrusion or attempted intrusion into CAMELEON’s systems;
  • any infringement or attempted infringement of the Website’s security measures;
  • any collection, extraction or use, in any way whatsoever, of the information and content present on the Website;
  • and, more generally, any act that may prejudice the rights and interests of CAMELEON.

In the event of any breach or fraudulent use of the Website observed by CAMELEON, the latter reserves the right to terminate the present contractual relationship, ipso jure, without notice or compensation, as well as to block any future access of the User to all or part of the Website.

  1. RESPONSIBILITIES

The Website is made available to the User free of charge. Despite the care taken in its design and analysis of its contents, the Website cannot be free of errors, downtime, flaws or defects and CAMELEON does not guarantee the accuracy, quality, legality or fitness for a particular purpose of the Website and the contents published therein.

The User is solely responsible for the use he intends to make of the Website, as well as for preserving the security and integrity of his data, hardware and software when he uses the Website in any way.

Thus, CAMELEON cannot be held responsible for:

  • any malfunction or contamination of the User’s computer equipment during or after browsing the Website, inability to access or poor condition of use attributable to such equipment, the Internet service provider, Internet network congestion, or any other reason outside of CAMELEON;
  • electronic or telephone communication costs incurred by the use of such equipment, which shall be borne exclusively by the User and shall not be supported by CAMELEON;
  • any interruption, temporary or permanent, of all or part of the functionalities of the Website, in particular in the event of maintenance, modification or updating of the Website, in the event of a technical incident and, more generally, in the event of an event beyond the control of CAMELEON;
  • any consequences that may arise from the contents of third party websites to which hyperlinks may be present on the Website;
  • any indirect damage suffered by the User;
  • any prejudice suffered by the User or a third party resulting from use of the Website that does not comply with these T&Cs and/or the General Terms and Conditions of Sale when they are applicable;
  • any breach of the obligations provided for in these T&Cs which would be due to or would find its origin in a fortuitous event or a case of force majeure as defined by article 1218 of the civil code.

In the event that CAMELEON is held liable for any damages not provided for in this section, its liability shall be limited to certain, actual and direct damages.

In no event shall CAMELEON, its directors, employees and, in general, its representatives and partners, be liable for indirect damages resulting from the use of the Website and the content published therein, including, without limitation, loss of profits, loss of opportunity or damages resulting from the loss of data caused by the inability to use the Website.

  1. MODIFICATION

These T&Cs are dated precisely and may be modified and updated by CAMELEON at any time, particularly in the event of changes to the Website or applicable regulations.

The applicable T&Cs are those published on the Website at the time the User accesses the Website. Consequently, the User is invited to consult the T&Cs each time he accesses the Website.

The present version of the T&Cs replaces all previous versions.

  1. TERMINATION OF THE WEBSITE

CAMELEON reserves the right to temporarily or permanently interrupt access to all or part of the Website, in particular in the event of cessation of the activity linked to the provision of the Website or in the event of collective proceedings.

  1. TRANSFER

Subject to applicable law, the User agrees that these T&Cs binding the User to CAMELEON may be assigned, transferred or contributed in any way. In the event of the transfer of CAMELEON to a third party, these T&Cs binding the User to CAMELEON shall automatically be transferred to the transferee.

  1. LINKS

The Website may include hyperlinks to websites or Internet sources other than those published by CAMELEON. Since CAMELEON cannot control these external websites and internet sources, CAMELEON cannot be held responsible for the availability of these external websites and internet sources, and therefore declines any responsibility for the content, products, services, advertising or any other material available on or from these external websites or internet sources. Also, the decision to activate the hyperlinks belongs exclusively to the User.

CAMELEON reminds the User that external non-affiliated websites or sources are subject to their own terms and conditions of use.

If the User wishes to create a hypertext link to the Website, he/she must obtain prior written authorization from CAMELEON by sending a request by email to the following address: contact@cameleon-association.org.

CAMELEON may, in its sole discretion, accept or reject any request made to it for this purpose. CAMELEON shall be under no obligation to accept any such request, nor to provide any reason for rejecting such request, if any.

  1. VALIDITY OF THE T&Cs

Each section of these T&Cs applies separately. Any modification of the applicable regulations in force or any decision of a court or a competent authority invalidating one or several articles of the T&Cs shall not affect the validity of the entire T&Cs. Such a change or decision does not authorize the User to disregard the valid provisions of these T&Cs.

  1. LANGUAGE

The present GTU are translated into English language. Only the French text will be deemed authentic in the event of a dispute.

  1. APPLICABLE LAW / JURISDICTION

These T&Cs and the operations arising therefrom shall be governed, interpreted and applied in accordance with French law.

In the event of a dispute concerning their interpretation or execution, CAMELEON and the User shall seek, before any legal action, an amicable agreement and shall communicate to each other all necessary information to this effect.

The User may also submit any complaints on the dispute resolution platform provided by the European Commission at the following address: http://ec.europa.eu/consumers/odr/. The European Commission will transfer the User’s complaint to the notified competent national mediators.

In the absence of an amicable agreement between CAMELEON and the User within two (2) months from the notification of the dispute to the other party, jurisdiction is expressly given to the courts of CHALON-SUR-SAONE.
